1. Acceptance of Terms

Welcome to Mobbily ("the Application"), an active driving risk prevention platform developed and operated by Trust SpA ("Trust", "we", "us", or "our"), a company incorporated under the laws of the Republic of Chile, Tax ID 76.815.904-1, with registered address at Av. Apoquindo Nº 4499, floors 6 and 10, Las Condes, Santiago, Chile.

By downloading, installing, accessing, or using the Application, you ("User", "you", or "your") agree to be bound by these Terms and Conditions of Use ("Terms"). If you do not agree to these Terms, you must not use the Application.

2. Service Description

Mobbily is a mobile application designed to promote safe driving through:

  • Mobile device manipulation detection: Identifies when the driver uses the phone while driving.
  • Speed monitoring: Detects speeding according to thresholds configured by the insurer.
  • Trip recording: Stores information about trips made, including location, distance, and duration.
  • Odometer verification: Allows uploading photographs of the vehicle odometer for verification.

The service is intended exclusively for users who have an active insurance policy with an insurer associated with the platform.

3. Usage Requirements

3.1 Eligibility

To use Mobbily, you must:

  • Be at least 18 years of age.
  • Possess a valid driver's license.
  • Have an active insurance policy with an insurer associated with Mobbily.
  • Have a compatible mobile device (iOS 14+ or Android 8+).
  • Accept these Terms and our Privacy Policy.

3.2 Device Permissions

To function properly, the Application requires the following permissions:

  • Location (always active): Required to record trips, detect speed, and generate driving statistics. This permission must remain active in the background while driving.
  • Motion sensors: To detect device usage while driving.
  • Camera: To capture odometer photographs when requested.
  • Notifications: To send alerts about detected risk events.
  • Storage: To temporarily save trip data.

Important: Denying these permissions may prevent the Application from functioning correctly and may affect your insurance coverage according to the terms of your policy.

3.3 Account Registration

You are responsible for maintaining the confidentiality of your access credentials and all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Acceptable Use

By using the Application, you agree to:

  • Provide truthful and up-to-date information.
  • Use the Application only when you are the vehicle driver.
  • Not attempt to manipulate, alter, or falsify recorded data.
  • Not use the Application for illegal or unauthorized purposes.
  • Not attempt to access other users' systems or data.
  • Keep your device secure and updated.
  • Not reverse engineer, decompile, or disassemble the Application.

5. Data and Privacy

The collection and use of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By accepting these Terms, you also accept our Privacy Policy.

Collected data may be shared with your insurer as established in your insurance policy and our Privacy Policy.

6. Intellectual Property

The Application, including but not limited to its code, design, logos, trademarks, texts, and graphics, is the exclusive property of Trust SpA or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Application in accordance with these Terms. This license does not include the right to:

  • Modify or create derivative works from the Application.
  • Use the Application for commercial purposes without authorization.
  • Remove or alter copyright notices or registered trademarks.

7. Limitation of Liability

7.1 Nature of Service

Mobbily is a support tool to promote safe driving. The Application does not guarantee accident prevention or the absolute safety of the driver.

7.2 Data Accuracy

While we strive to provide accurate data, the accuracy of information depends on factors such as GPS signal, device conditions, and other elements beyond our control. We do not guarantee absolute accuracy of location, speed, or event detection data.

7.3 Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.4 Limitation of Damages

IN NO EVENT SHALL TRUST SPA, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM THE USE OR INABILITY TO USE THE APPLICATION.

8. Indemnification

You agree to indemnify and hold harmless Trust SpA, its directors, employees, and agents from any claims, damages, losses, costs, or expenses (including attorney fees) arising from your use of the Application or violation of these Terms.

9. Modifications

We reserve the right to modify these Terms at any time. Changes will take effect immediately upon posting in the Application or on our website. Your continued use of the Application after such changes constitutes your acceptance of the new Terms.

For material changes, we will notify you through the Application or by email at least 30 days in advance.

10. Termination

We may suspend or terminate your access to the Application at any time, with or without cause, with or without prior notice. You may stop using the Application at any time by deleting it from your device.

Upon termination, sections of these Terms that by their nature should survive will remain in effect.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Chile, without regard to its conflict of law provisions.

Any dispute arising from these Terms or the use of the Application shall be submitted to the exclusive jurisdiction of the ordinary courts of justice of the city of Santiago, Chile, expressly waiving any other venue that may apply.

12. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Trust SpA regarding the Application.
  • Severability: If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full force and effect.
  • Waiver: Failure to exercise any right under these Terms does not constitute a waiver of that right.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
